What happens when police suspect you?
An initial interaction with a person suspected of DWI is the first step after the police pull you over. In Missouri, the police follow these steps to determine if someone is DWI.
- Do a field sobriety test with a walk-and-turn, one-leg stand and horizontal gaze test.
- Use a portable breathalyzer to measure your BAC (blood alcohol concentration).
- Read your Miranda rights and place you under arrest if the officer thinks you are impaired.
- Bring you to the police station or medical facility for chemical testing or DUI Evaluation to gauge a more accurate breath, blood or urine test and determine if you have substance abuse.
- Go through booking, which includes taking fingerprints, photographs and recording personal information.
Your release depends on the circumstances. You may either be released on bail or held until a court appearance.
When can I call my lawyer?
Although it may be stressful for you, you should call your lawyer after passing the “critical stage,” when the officer starts reading your Miranda rights and placing you under arrest. It is crucial to have a lawyer present to guide you through the DUI Evaluations so the police do not overlook your rights and you can restore your license.
